What is the law governing smoke bombs and flares at football matches?

The Sporting Events (Control of Alcohol etc.) Act 1985.

It is on offence for a person to enter or attempt to enter a football ground while in possession of a flare, smoke bomb or firework. The sentence for these offences can be as much as three months in prison, and in many cases, fans who have no previous convictions are being given prison sentences for attempting to enter a football ground with a smoke bomb in their pocket as the courts take these offences very seriously.

There are two different offences (1) possession in the football ground; and (2) possession while attempting to enter. How long will the Football Banning Order last?

Most football banning orders imposed by a court after a conviction for a football related offence are for 3 years. This does not only prevent the fan from attending football matches for the next 3 years, but can prevent them from entering the town of their football team on match days, and require them to hand their passport to the Police when the England or Wales national team are playing overseas (as appropriate). A football banning order will show up on a Criminal Records Bureau checks and may prevent a fan from obtaining a visa to travel to countries such as the USA, or working in certain professions, such as working with children.

In addition, football clubs have issued life bans to fans who have been convicted of possession of a firework, flare or smoke bomb, meaning that even once the football banning order has expired, you may still be banned by your club.

What is the law on the carrying of flares, smoke bombs and fireworks for people aged under 18?

The Fireworks Regulations Act 2004

In addition to the above law, it is also an offence for a person under the age of 18 to be found carrying a firework in a public place. Smoke bombs have the Firework Standard label on them and will be classed as a firework. This doesn't just apply to people under 18 going to football matches but applies to all under 18 year olds when they are out in public places such as the park or town centre. The police can issue an £80 fixed penalty notice to anyone under the age of 18 found in possession of a firework in a public place.

Is it an offence for an adult to have a firework in their possession if they are not going to a match?

No, it is not illegal for a person over 18 years to possess a firework, flare or smoke bomb, but it is illegal for a person over 18 years to let off the firework, flare or smoke bomb in a public place. A person over the age of 18 cannot legally be arrested for being in possession of a firework, flare or smoke bomb, other than when entering or attempting to enter a football match. For instance, the arrest of a football fan at a service station for possession of a smoke bomb in their car is an unlawful arrest unless the fan admits to the police officer that they intended to take the firework, flare or smoke bomb into the football ground later that day.

Be warned that even though fans may not think that having a smoke bomb or flare in their pocket is a serious offence, the police and football club take it very seriously and even a fan with no previous convictions faces a real risk of going to prison.

Let’s hope the cctv in the west stand caught the incident/s.

One was thrown over our heads towards the front and nearly struck the ball boy sitting up against the advertising hoardings. It could’ve caused a serious injury to him.

The second fell right next to us. The burn marks on the floor it produced was bad. Goodness knows what would’ve happened if it hit or settled onto someone.

Smoke bombs and pitch invasions are getting more dangerous. Something needs to be done asap to stop this.

The coppers at Everton last week were stood watching people let off smoke bombs, and in one case a shipping flare and did nothing. The don’t seem bothered.

This needs to be curtailed before someone gets hurt.

Walsall away many years ago some clown did a smoke bomb but he asked around before setting it off if anyone had breathing difficulties. That level of consideration you just don’t get these days :(

It’s not a ridiculous reaction to two flares. They are dangerous and unpleasant. As already said, the first just missed a young child, the 2nd landed a few feet from us. It’s an awful acrid stink and if people don’t react now it will only get worse and someone will get hurt.
I don’t give a ?what the French and Germans do either.

We have very reluctant stewards … who don’t like searching… apart from my partners handbag…

They bloody stink those flares, and yes should be banned. Along with inflatable footballs. Alright for thirty seconds but when your trying to concentrate on a game…also if wanted extra exercise keeping a ball up in the air I’d join a Gym.

Flares are just an accident waiting to happen. The first one thrown yesterday was very close to lots of people. There were two young children on the shoulders of their parents in Bee costumes close by. Not sure about the second one but it ended up in the middle of the stand. These are just too dangerous to be thrown around.

When I was eight, a friend and I played a game that involved throwing darts at each other's legs. The one who got closer to the other person won. All went well until, suddenly, he won. I looked down and saw a dart sticking out of my leg.

In other words, things don't lose the potential for danger just because they haven't happened yet.

The fact that it happens a lot in Europe doesn't make it the best thing since sliced bread. The Italians, for example, often prefer to use suppositories when they're under the weather rather than tablets.

People with respiratory conditions such as asthma or cystic fibrosis might not see it that way.

Smoke bombs release fumes that may contain zinc chloride, zinc oxide, hydrochloric acid, hexachloroethane, calcium chloride, and aluminium.

At Everton, I had a terrible coughing fit and had difficulty breathing for a while, which surprised me as most of the flares were thrown onto the pitch at the other end.

The throwing part is what the concern is ffs. Not about what it creates for some.

Throwing a smoke bomb down towards supporters and the ball boy showed a complete disregard for the safety of others. A pathetic and gutless thing to do.

I do hope they find the idiot who did it.

There greater the speed, the greater the chance of death if a pedestrian is hit. This is very common knowledge and even small increases in speed make a significant difference.

Clearly you are very passionate about this issue, which is fair enough. If you believe they are totally safe and enhance the match day experience, maybe you should take the safety evidence you’ve gathered and petition the FA, as you’re clearly not getting much support on here.

(But while we are on that topic... It is only *technically* illegal to drive at 32mph... no police force in the land prosecutes you for this DANGEROUS act).
