But where offences come under both criminal law and discipline codes one course of action may be more appropriate than the other. For example, head butting an opponent is an offence under the discipline code, it's also an offence under criminal law. Do you want the police stepping in to deal with that?

The police should not have got involved. As with Suarez , the FA should have moved swiftly to deal with the matter. As with any matter where there is the slightest hint of racism the police tend to go OTT. I don't condone racism but commonsense should prevail.

As I understand it, the complaint was made TO the police by a spectator NOT to the FA by the player. Therefore, the police had no choice but to investigate and take appropriate action. The FA will not intervene in the interim because it could damage any legal action. Completely different situation to the Suarez affair

Win the trophy with Terry raising it aloft and the picture could potentially be all over the world a few days later if he gets convicted. Potentially not the best advertisement for both England football team and England in general...

Don't think he should be captain. He should probably go as a squad player depending on who's fit at the time but if we had to chose between that and Terry captaining the winning side and lifting the trophy then I'd take the latter. As it is we'd just be going along with the innocent till proven guilty line, also most of the potential captains aren't exactly whiter than white.

Hopefully this'll be "JT" and the Golden Generation's last tournament finals anyway, they need a complete clear out after this. At the time of the 2014 WC finals, Terry will be 33, Ferdinand 35, Cole 33, Lampard 36 and Gerrard 34.

I have to agree. Both Ferdinand and Lampard arent even guaranteed places in their club team and Terry proved to be woefully inept and off the pace 2 years ago at the last WC

Claire has it right. As the police received a complaint about Terry's alleged actions they have to investigate. Terry has the right to a free trial. An FA charge/ban now would make it an unfair trial.

To be fair I think the England rugby team have far more discipline issues than the football team based on the last year........

It's questionable that he is guilty of anything. We have a reached a stage in society where some sections can say what they want and others can't. What if is deemed to have said is hardly groundbreaking bearing in mind the truth behind it and the provocation. I hold no torch for the guy but who is captain surely is up to the manager not men in suits. My England team would consist of many more players from lower divisions anyway.

The bloke is a PR nightmare who is past his best in any case. I thought after the world cup failure we were going to rightly write off this last batch of senior players and rebuild a squad for the future. It never happened.

The FA (for a change) have done the right thing. As captain of England, Terry would be the figurehead and main spokesman for the England players and representing the FA at the same time. The FA, quite rightly, do not want a player with this anti-social criminal charge to be representing them in this fashion. The FA have also taken advice from other players, some who we have been led to believe would have found it difficult to work with Terry, and understandably so. The FA would be completely within their right to ask Capello not to pick him, as in any job someone charged with a similar offence would be expected to be suspended on full pay. If there is no contract between Terry and the FA, then i cannot see why the FA do not have the right to instruct Capello not to pick him and therefore represent them.

The sooner this lot of pratts (Terry, Cole, Ferdinard, Lampard and yes Rooney) are out of the squad the better.

Probably for the best, imagine if the trial was a couple of weeks before the Euros he'd have to stay as captain until then. At least now we can slightly take the sting out of it several months before.

Agree with most of this. I think it's more the tip of the iceberg if it was a player with no previous I wouldn't mind as it is innocent till proven guilty. The fact the decision seems to have come partly from players talking to the FA says it all really, it's not just because he's got a court case coming up it's because as you say he's so divisive.

Also if it's true Capello wanted to keep him as captain, why the hell was he quick to sack him for sleeping with a teammates ex but not for being charged with racism?

I don't know why "England Captain" is such an important position anyway, players at that level shouldn't need a leader. What does the England captain do anyway? He just tells the press what they want to hear through the use of cliches and soundbites, and on the pitch it's his job to shout "COME ONNNN!!" at his fellow players when they go up for a corner.

He definitely shouldn't captain the squad, because a man who is openly racist shouldn't be captaining those of the skin colour he's against, for a country whom have thousands of people with that same skin colour supporting the side, but I've no problem with him being there. I'm not a racist, maybe a bigot at times, but who isn't? What he said to Ferdinand was unacceptable on a football pitch, Ferdinand shouldn't have been subject to that kind of abuse. However, he should have been fined and suspended there and then, not 8 months after, until the Police are done with him. I don't think one racist comment should stop him from going to the Euro's, football isn't the bastion of all things good and equal. There will be players in every team who will have done one thing or another to disgust us in one way or another.

Terry didn't assault Ferdinand, didn't put his life in danger, didn't infringe upon his rights, all he done was verbally abuse him. Whilst it shouldn't be anywhere near a football pitch, I feel banning him from a competition that has nothing to do with a league game 8 months after the incident happened is over the stepping the mark, and all we're doing is creating an overly sensitive society. Yes there are racists out there, that will never change, yes it's not acceptable to verbally abuse someone because of their skin, but is it really that bad? I've had abuse in the past for being partially deaf, something as natural as a man having black skin, if I were a footballer, would someone calling me a deaf **** really be just cause to stop them from going to an international tournament? I doubt they'd even get a ban or a fine.

The fact is slavery isn't a problem anymore, neither are racially motivated attacks (not to the level they have been in the past anyway), neither are the likes of the BNP, a black man has the same rights as a white man now. Racism is obvious active in the upper echelons of society, it's obviously alive in the police in deprived areas especially, however what Terry said cannot be compared to that. A man should be allowed his opinion and should be allowed to air that opinion, if it's derogatory to something completely natural such as skin colour or sexual preference then it should be left to private domains such as their own homes, if he doesn't leave it to that then he should rightfully be punished, but let's not wrongfully punish John Terry because there were people previously, and today, shared his ignorance but profited from and deprived others through it.

Totally over hysterical reaction. Ferdinand provoked Terry anyway and Ferdinand knows that. I don't know if it has been mentioned before, but it seems to me that he had a tactic of getting an adjournment so that he could continue his path into the Euros.
It would seem that his gamble that the FA would countenance this was particularly ill judged - unsurprisingly to me and many others, it would seem.
