It may well be about whose insurers pay. If someone gets injured in a freak accident and it ends his career, then his club's insurers would pay; if it was malice/negligence from someone else, their insurance might have to pick it up. The injured player might potentially also make a personal claim.

Liability insurance can be at an extremely high level, for Mr Smith to plead guilty though surely shows it was intentional..or is he just admitting that his tackle did end his career, whether it be an innocent or rash tackle? :shrug:

i have £5 million of physical damage to martial arts opponents insurance and i think £10 million (or maybe its £1million) financial liability insurance, so therefore could i smash someones head clean off and then steal their house with no come back? rsvp

Seems excessive but I suppose it's the starting point. I don't know about these things but I can't imagine him getting remotely near that with no playing career behind him when it happened and the his potential based on conjecture.

Agreed. It will be nearer £160K than 16M imho.

He's just another one of along line of Man Utd starlets hailed as the next Ryan Giggs. How many of them have made a big living from the game so far

I read that and I think it is a ridiculous claim. Whilst he MIGHT have had a long, well-paid career he might equally have faded out after a season or two like a lot of young players and found himself dropping down the League or even out of the game altogether.

He has the right to claim as much money as he feels he should be entitled to it is up those in charge to decide what is reasonable.

If you were in his position what would you do? "Well actually chances are I might have done my cruciate 3 times in 3 years and been forced to retire early so I'll only put in a claim for £2 million or so..."

Can't blame him for trying to get as much as he can, I guess the fact that he from that club in the Premiership doesn't help given the opinion lower league fans have of that league and especially of clubs like Man Utd.

exactly it is almost as if people are saying "someone crashed into my car and totalled it and injured me so that I could not work in my current job anymore. We both have insurance, but I am not going to make any claim as I am able to do other work so should go get a new job and buy a new car and live with the fact that sh*t happens and I don't have a chance to do what I love anymore!

Which is why the actual damages were lower than the estimate of potential. He got over £400k in actual lost earnings.

The individuals involved are not relavent.

It is the Insurance Policy at work in this case - He was insured, he had the right to make a claim, the claim was heard in court, he was made an award.

I have insurance cover in case I should be unable to continue working and earning my salary. It is no diferent. It is only the careers that are different.

In this case, I would agree the system has worked. The numbers are indeed high but at the "Time of the injury" he had the potential to earn millions and that is what the claim has to be based on.
